[1] Section 104(a) of the Budget Control Act of 2011 (Public Law 112–25) repealed Section 275 of this Act . That section included the sunset date, and so in repealing it, the Budget Control Act of 2011 removed all expiration dates from the Balanced Budget and Emergency Deficit Control Act of 1985. Hence it is permanent, subject, as any law, to future Congressional amendment.

Even though the entire Act is now permanent, certain provisions, such as section 252, “Enforcing Pay-As-You-Go”, and section 253, “Enforcing Maximum Deficit Amounts”, by the terms of their application, are no longer enforceable. Section 2520, for example, only applies in its enforcement mechanism to bills or joint resolutions enacted during fiscal year 2002 or before.

Before its repeal, Section 275 of the Balanced Budget and Emergency Deficit Control Act of 1985  read as follows:

sec. 275. effective dates.

(a) In General.——

(1) Except as provided in paragraph (2) and in subsections (b) and (c), this title and the amendments made by this title shall become effective on the date of the enactment of this title and shall apply with respect to fiscal years beginning after September 30, 1985.

(2)(A) The amendment made by section 201(a)(2), and the amendment made by section 201(b) insofar as it relates to sub- sections (c), (f), and (g) of section 302 of the Congressional Budget Act of 1974 and to subsections (c), (d), and (g) of section 310 of that Act), shall become effective April 15, 1986.

(B) The amendment made by section 212 shall become effective February 1, 1986.

(b) Expiration.—Sections 251, 253, 258B, and 271(b) of this Act, and sections 1105(f) and 1106(c) of title 31, United States Code, shall expire September 30, 2002. The remaining sections of part C of this title shall expire September 30, 2006.

(c) OASDI Trust Funds.—The amendments made by part D shall apply as provided in such part.

Effective Dates Amended and repeal

Section 275, first enacted in the Balanced Budget and Emergency Deficit Control Act of 1985 (Pub. L. 99–177, title II, §275, Dec. 12, 1985, 99 Stat. 1100), was amended as follows: 

Pub. L. 100–119, title I, §106(c), title II, §210(b), Sept. 29, 1987, 101 Stat. 780 , 787 amended this section to provide for the expiration of a new section 271(c) (BBEDCA), which was added to provide for a three-fifths voting requirement to sustain an appeal of the ruling of the Chair on certain points of order under the Congressional Budget Act of 1974.

Pub. L. 105–33, title X, §10212(a), Aug. 5, 1997, 111 Stat. 712 , which provided:

that the amendment by section 212 (BBEDCA) of Pub. L. 99-177 (amending section 402 (CBA) was effective Feb. 1, 1986; that sections 251, 253, 258B, and 271(b) of BBEDCCA (Pub. L. 99-177), and sections 1105(f) and 1106(c) of title 31, United States Code, were to expire Sept. 30, 2002; and

that the remaining sections of part C of title II of Pub. L. 99-177 (enacting this subchapter) were to expire Sept. 30, 2006.

Section 275 was repealed by Pub. L. 112–25, title I, §104(a), Aug. 2, 2011, 125 Stat. 246 .
