Year-ahead requests for authorization of new budget authority

Sec. 607. Notwithstanding any other provision of law, any request for the enactment of legislation authorizing the enactment of new budget authority to continue a program or activity for a fiscal year (beginning with the fiscal year commencing October 1, 1976) shall be submitted to the Congress not later than May 15 of the year preceding the year in which such fiscal year begins. In the case of a request for the enactment of legislation authorizing the enactment of new budget authority for a new program or activity which is to continue for more than one fiscal year, such request shall be submitted for at least the first 2 fiscal years.

This section of the Congressional Budget Act of 1974 added to the requirements of the President’s budget submission, although reference to it is not explicitly made. Section 607 (CBA) was repealed by Pub. L. 97-258, which reformed title 31 of the U.S. Code, without substantive revision. This Act transferred this text from 31 U.S.C. 11c to 31 U.S.C.  1110.  In its classification to the Code, certain editorial changes were made, which are described as follows:

§1110. Year-ahead requests for authorizing legislation

A request to enact legislation authorizing new budget authority to continue a program or activity for a fiscal year shall be submitted to Congress before May 16 of the year before the year in which the fiscal year begins. If a new program or activity will continue for more than one year, the request must be submitted for at least the first and 2d fiscal years.

The words “Notwithstanding any other provision of law” are omitted as unnecessary. The words “the enactment of” before “new” are omitted as surplus. The words “(beginning with the fiscal year commencing October 1, 1976)” are omitted as executed. The words “a request for the enactment of legislation authorizing the enactment of new budget authority for” are omitted for consistency in the chapter.

JOINT EXPLANATORY STATEMENT OF CONFERENCE COMMITTEE

The managers on the part of the House and the Senate of the conference of the two Houses on the amendments of the Senate to the bill (H.R. 7130) issued an explanatory statement of the legislation. This was included in a House Budget Committee print in 1975 after the bill’s enactment. It included the following description of this section:

Section 607. Advance Requests for Authorizing Legislation

The Senate amendment provided for the study of advance appropriations by OMB and the Congressional Budget Office. The Senate amendment further provided for the submission of advance estimates where these are authorized by law.

The conference substitute requires that beginning with programs for fiscal year 1977, the Administration shall submit no later than May 15 of the previous calendar year requests for authorizing legislation for the fiscal year following the en-suing fiscal year. Requests for new program authorizations shall be submitted for at least the first two fiscal years.

The intent of this provision is to develop a pattern for the enactment of authorizing legislation at least one year in ad-vance of the fiscal year to which it first applies.

This section does not affect any provision of law which exempts an agency of the Federal Government, or any of its activities or outlays, from inclusion in the Budget.

CLASSIFICATION TO THE U.S. CODE

This section was classified to 31 U.S.C. 11c when enacted. Public Law 97-258 repealed sections 601-605 and 607. See Pub. L. 97-258, sec. 5(b), 96 Stat. 877, 1082 (Sept. 13, 1982). Section 223 of the Balanced Budget and Emergency Deficit Control Act of 1985 repealed section 606. Sections 601-605 and 607 were codified in sections 1105, section 1106, section 1108, and section 1110 of  title 31.
